Non-Functional Selection Grade (NFSG) in CSCS

Subject: Grant of NFSG to UDCs of CSCS – regarding

The undersigned is directed to refer to this Departments O.M.No.20/49/2009-CS.II (B) dated 22nd June, 2011 vide which a new grade of UDC Non-Functional Selection Grade (NFSG) in CSCS in the Grade Pay of Rs.4200/- in Pay Band-2 was created with effect from 22.06.2011.

2. It has been decided in consultation with D/o Expenditure to operationalize the NFSG of Grade Pay of Rs.4200/- in the case of UDCs of CSCS. The cadre units are requested to grant Grade Pay of to 1104 UDCs figuring in the list attached as Annexure —l subject to their suitability with effect from 22.06.2011 till the date of their promotion as Assistants on ad-hoc basis / Retirement / Expired / VRS / resigned etc whichever is earlier. The cadre units are also requested that the cficiels who have already resigned I retired / taken VRS / Expired etc prior to 22.6.2011 may not be qranted the Grade Pay cf Rs. 420C/-. Further, those UDCs who have been promoted to the grade of Assistant on ad-hoc basis prior to the issue cf O.M. No. 20/49/201 -CS.!I (B) dated 226.2011, have been excluded from the list of beneficiaries.

3. While granting the Grade Pay of Rs. 4200/- the cadre units may follow the procedure laid down in sub-pera (ii) to (v) of para (b) of this Department’s OM. No.20/49/2009-CS.ll (B) dated 22 06.2011. The pay fixation may be done under Rue 13 of CCS (Revised) Pay Rules, 2008 and other relevant instructions on the subject. The financial implications would have to be met by the respective Ministries / Departments.

4. Cadre units are also requested to send a compliance report in the enclosed proforma (Annexure-Il) to CS.II Division, detailing the officers who have been granted NFSG, by 30.06.2015. Since the Select List of 2003 (Extended) of UDC grade is under litigation, the grant cf Grade Pay of Rs. 4200/- would be subject to the outcome of the SLP (Civil) No, 10342/2015 filed by Shri Pankaj Kumar Mishra and others before the Hon’ble Supreme Court and O.A, No. 794/2015 filed by Shri Kamal Kumar Gupta and others before CAT Principal Bench, New Delhi and also orders in any other connected matter by any competent authority. This may be Included in the orders to be issued by the Cadre Authorities.

5. M/o Finance, D/o Expenditure’s vide their ID No. 94952/2015/E-III (A) dated 01-06-2015 have concurred with the proposal.
6. In case of errors/omissions if any, the same may be brought to the notice of this Department immediately.

OFFICE MEMORANDUM

Subject: Creation of a new grade of UDC (NFSG) and Stenographer Grade‘D’ (NFSG) in CSCS and CSSS respectively.

It has been decided to create a grade of UDC ‘Non Functional Selection Grade’ (NFSG) in Central Secretariat Clerical Services (CSCS) cadre and Stenographer Grade ‘D’ (NFSG) in Central Secretariat Stenographers’ Services (CSSS) Cadre in the grade pay of Rs. 4,200/- in Pay Band-2 with immediate effect subject to the following conditions:

(a)UDCs of CSCS and Stenographers Grade ‘D’ of CSSS shall be eligible for placement in the Non Functional Selection Grade on completion of 5 years of approved service as UDC/Stenographer Grade ‘D’ subject to the condition that the total number in the grade will be restricted to 30% of the sanctioned strength (i.e.1104 in the grade of UDC and 385 in Steno Grade ‘D’).

(b)The officials will be placed in the Non Functional Selection Grade as per the following procedure:

i) Department of Personnel and Training (D0P&T) will issue a Zone of Consideration for placement of eligible officials in NFSG as per the Common Seniority List prepared and maintained by D0P&T in respect of UDCs of CSCS and Stenographers Grade ‘D’ of CSSS.

ii) An internal Committee will be constituted by the Cadre Units to review the cases of officials for placement in the Non Functional Selection Grade and to make suitable recommendations.

iii) The Committee shall consider the last 5 years ACRs/APARs of the officials. The Committee should satisfy itself that the overall performance of the official is “GOOD” in the last 5 years ACRs/APARs. Such officials would be considered suitable for placement in the ‘NFSG’.

iv) There should be no adverse entries in any ACR/APAR. If there are any adverse entries, it should be clearly brought out in the minutes as to why the official has been proposed for Non Functional Selection Grade in spite of adverse entries. The minutes should also include a certificate that there is no other factor or aspect affecting the official which will disqualify him/her for grant of ‘Non — Functional Selection Grade’.

v) SC/ST officials considered for placement in their turn to the ‘NFSG’ may be included in the Select List of ‘NFSG’ even if they do not fulfill the criteria as laid down in S.No. (iii) above, provided they are not found unfit by the Committee.

2. This issues with the concurrence of Department of Expenditure, Ministry of Finance vide their U.O. No. 10/1/2010-IC dated 14.6.2011.

HISTORY:::: CAT JUDGEMENT ORDER, PORT BLAIR DT:23.05.2007 in favour of LGC, HGCs

Dear friends,

Please enclosed herewith a copy of CAT Judgement Order vide OA No. 09/AN/2006 dt: 23.05.2007 wherein, the Hon'ble CAT had given favourable judgement in favour of LGC HGCs of AC Cadre. Accordingly, the same was taken-up by the A & N Administration at the given time. But unfortunately, the Ministry of Finance has rejected our demand.

Now, it is the right time to take-up the matter again with the appropriate channel as our demand was not considered by the 6th CPC as well as in the 7th CPC. We will once agains submit our demand before PMO and if the same was considered we will approach appropriate bench of CAT. The Clerical Cadre Branch of A & N Islands is very much concern about the legitimate demand of LGCs and HGCs of AC Cadre.

West Bengal:

Besides, as per information given by Shri S. Banerjee UDC, IBM Kolkata the pay Band and Grade pay of LDC & UDC in West Bengal State Government is Rs. 5400-25200+ 2600 and Rs. 7100-37600 + 3600/ respectively.  

Uttar Pradesh:

Shri Amit joshi has written in our blog (www.aiamshq.blogspot.in) “I am employee of Uttarkhand Govt and that scales implemented from Uttarpradesh… we did one month strike for same scale like Uttarpradesh and Govt give us from Jan 2013.”  This shows the Pay structure of LDC and UDC in Uttar Pradesh State is similar to the pay structure of LDC & UDC in Utarakhand.

From the above it is clear that several of the State Governments, even after implementing 6th Pay Commission, have raised the grade pay of the Clerical staff working in their states. Thus the demand for a hike in the grade pay of the LDC & UDC posted in Government of India Offices especially in the Non CSCS Offices is genuine.
